Terms and Conditions

1. About the business
James Wolfisz Photography is operated by James Wolfisz as a sole trader. References to “I”, “me” and “my” mean James Wolfisz trading as James Wolfisz Photography.
Business and home studio address: 37 Turpins Chase, Welwyn, AL6 0RP, United Kingdom.
Email: james@jameswolfisz.com.
These terms apply to consumer bookings and purchases made directly with me, including through my Pixieset website and galleries. Your booking confirmation or order summary sets out the specific services, products, prices and timings agreed. These terms do not restrict your statutory consumer rights.
2. Bookings, prices and payment
An enquiry or consultation does not commit you to a booking. A booking is confirmed when I accept it in writing and receive any agreed booking payment. An artwork order is accepted when I confirm it in writing. An automated payment acknowledgement alone is not acceptance of an order.
Before you commit, I will confirm what is included, the total price, payment schedule and any delivery charges. Prices are in pounds sterling. I am not currently VAT registered and do not charge VAT. Changes to future prices do not change an accepted booking or order.
Booking payments count towards the agreed total; they are not automatically non-refundable. Any outstanding amount is payable on the dates stated in your confirmation. Additional artwork or digital images are optional unless expressly included in your agreed package.
If a payment is overdue, I will contact you and give reasonable notice and an opportunity to resolve it before suspending services or production. Any cancellation charge remains subject to section 4 and your statutory rights.
3. Sessions and animal welfare
Please tell me about relevant pet behaviour, handling needs, illness or injury before the session. You remain responsible for supervising and safely handling your pet and any accompanying children. Please follow reasonable safety instructions.
Sessions are patient and guided by the animal's comfort. I may pause or stop a session if continuing would create a safety or welfare concern. We will discuss a suitable alternative, such as rescheduling, and any refund or reasonable costs in light of the circumstances. This does not remove your rights if I fail to provide the service with reasonable care and skill.
Please arrive at the agreed time. If you are delayed, contact me as soon as possible. We will discuss whether the session can proceed or needs to move.
My portfolio demonstrates my photographic and editing style. We can discuss preferences in advance, but individual poses and expressions depend on your pet and cannot be guaranteed. The number of finished photographs is as agreed in your booking; a finished gallery does not include every exposure, rejected photograph or RAW file.
4. Rescheduling and cancellation
You may move your session once without a rescheduling charge by giving at least 48 hours' notice before the agreed start time, subject to availability. Further changes or shorter notice will be discussed individually. Please contact me promptly if you or your pet are unwell or there is an emergency; I will consider these circumstances fairly.
You may cancel by emailing james@jameswolfisz.com. Outside any applicable statutory cancellation period, I may retain or charge only a reasonable amount reflecting loss directly caused by the cancellation that I cannot reasonably avoid. I will take account of work already carried out, costs saved and whether I can rebook the appointment. I will explain any proposed deduction and refund the balance. There is no automatic forfeiture of the booking payment. The same approach applies to missed appointments.
If I need to cancel, I will contact you promptly and offer a suitable replacement date or a refund for services and products I cannot provide. You do not have to accept an alternative date. Your rights to other remedies where legally applicable remain unaffected.
5. Cooling-off rights for remote bookings
For photography service bookings made online, by telephone or email, I offer a 14-day cancellation period from the day after the contract is made. You may cancel during this period without giving a reason. This contractual promise applies even if a particular booking falls within a statutory exception. Any wider statutory right remains unaffected.
If you want services to start during these 14 days, I will obtain your express request first. If you then cancel, a proportionate charge may be made for services actually supplied where legally permitted and explained before you agreed. You lose any applicable statutory service cancellation right after full performance only where you expressly requested early performance and acknowledged that consequence. No such consent is inferred simply from payment or acceptance of these terms.
Refunds due under statutory cancellation rights will be made within the applicable legal period, normally within 14 days of being informed of cancellation, using the original payment method unless you expressly agree otherwise, without a refund fee.
You can cancel by any clear statement; you do not have to use the following form:
To: James Wolfisz Photography, 37 Turpins Chase, Welwyn, AL6 0RP; james@jameswolfisz.com.
I give notice that I cancel my contract for: [service/order].
Ordered/booked on: [date].
Name: [name].
Address: [address].
Date: [date].
Signature: [only if sent on paper].
6. Artwork orders and approval
Your order confirmation will identify the selected images, product, image dimensions, frame or finish, quantity, price and estimated delivery or collection arrangements. Please check these details before approving production. I will explain whether a proof or crop approval is required and whether revisions involve an additional agreed charge.
Listed artwork dimensions refer to the photographic image unless stated otherwise. Overall dimensions vary with the mount, frame and finish. Mock-ups illustrate presentation and may not show actual scale. Screen appearance can vary from a finished print; this does not excuse material differences from the agreed description or defective work.
Artwork made using your photographs is personalised. The statutory change-of-mind cancellation right for distance purchases generally does not apply to clearly personalised goods. Please contact me immediately if you want to change or cancel an order: I will consider what can reasonably be stopped and explain any unavoidable costs. This exception does not affect rights relating to faulty, misdescribed or otherwise non-conforming goods.
7. Timings, delivery and problems
Estimated reveal, gallery and delivery dates will be agreed before booking or ordering. Where a delivery period longer than 30 days is required, I will obtain your agreement. I will inform you of a significant delay and discuss your options, including cancellation where you are legally entitled to it.
Where I arrange delivery, goods remain at my risk until you or someone you nominate takes physical possession. Please tell me promptly about damage, missing items or a problem so I can arrange an appropriate remedy. A request for prompt notification does not impose a deadline that removes your statutory rights.
Goods must meet their description, be of satisfactory quality and be fit for purpose. Services must be supplied with reasonable care and skill. Depending on the circumstances, your rights may include repair, replacement, repeat performance, a price reduction or a refund. Please email me with details and, where practical, photographs of a product issue. I will arrange necessary returns at my expense where legally required.
8. Copyright and digital images
I retain copyright in my photographs. Purchased digital images include a non-exclusive licence for your personal, non-commercial use, including personal social sharing and making your own prints. You may give personal prints as gifts. Copyright is not transferred by buying a print or digital file.
Commercial use, resale, licensing to others or advertising use requires separate written permission. Third-party printing quality is outside my control, but this does not limit my responsibility for the supplied digital files. RAW files and working edits are not supplied unless separately agreed.
For digital downloads supplied during a statutory cancellation period, I will obtain any legally required express consent and acknowledgement before supply. Acceptance of these terms alone does not waive cancellation rights. Digital images supplied on a USB stick are subject to the rules applicable to that order; the download exception is not automatically applied to a physical USB product. Your rights if digital content is faulty or misdescribed remain unaffected.
9. Promotional image use
I will ask for separate, optional permission before using your client photographs on my website, social media or printed marketing. Refusing permission does not affect your booking or purchase. The permission request will identify the intended uses. For identifiable people, permission will be sought from the relevant individual or an appropriate parent or guardian for a child.
You can withdraw permission by emailing me. I will stop new use and remove images from channels I control where reasonably practicable. I cannot recall printed materials already distributed or guarantee deletion of copies independently shared by others. Withdrawal does not make earlier lawful use unlawful.
10. Galleries and file retention
Online galleries are normally available for 90 days after delivery. Finished images are normally retained for three years after delivery for reorders; RAW files and working edits for 12 months. I will confirm gallery expiry when delivering it. These periods are storage policies, not a guarantee of indefinite retrieval. Please download purchased files during the availability period and keep your own backups. This does not exclude remedies for a failure to supply what you purchased.
Personal information is handled as described in the Privacy Policy.
11. Responsibility, complaints and applicable law
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot lawfully be excluded. I remain responsible for foreseeable loss and damage caused by my breach of contract or failure to use reasonable care and skill. I do not exclude liability for my own negligence through a blanket pet, property or equipment disclaimer.
For a complaint, email james@jameswolfisz.com with your booking or order details and the outcome you are seeking. I will investigate and respond within a reasonable time. You may also seek advice from Citizens Advice or use any legal remedies available to you.
These terms are governed by the law of England and Wales. This does not deprive a consumer of mandatory protections or rights to bring proceedings in their home jurisdiction where applicable. Changes to these terms apply to future bookings and orders, unless a change to an existing agreement is expressly agreed with you.
